1. Scope and Acceptance
These Terms of Service (“Terms”) apply to your use of the website at www.flooritize.com and to orders placed through it. The website is operated by Flooritize LLC under the name Flooritize Flooring (“Flooritize,” “we,” “us,” or “our”).
By using the website or placing an order, you agree to these Terms, together with our Refund policy, Shipping policy and Privacy policy, which form part of these Terms. If you do not agree, please do not use the website or place an order. These Terms do not limit any right you have under applicable law that cannot be waived.
2. Product Descriptions, Images and Variation
We try to describe products accurately, using information supplied by manufacturers and suppliers. Product images, swatches and colors are visual references only. Actual appearance can vary with screen settings, lighting, photography, natural material characteristics and production lots.
Natural stone, ceramic, porcelain, mosaic and other surface products can vary in color, shade, veining, texture and finish, and products from different production lots may not match exactly. Specifications, dimensions and packaging may change as manufacturers update their products. Section 8 of our Refund policy explains how variation is handled.
3. Pricing, Order Acceptance and Payment
Prices are shown in U.S. dollars and may change without notice. Each product shows the unit it is sold in, such as per box, piece, square foot or linear foot. Please check the unit before ordering.
Your order is an offer to buy. We accept an order when we confirm it and the products are allocated for fulfillment. We may decline or cancel an order before acceptance, for example if a product is unavailable, if a price or description was displayed in error, or if we cannot verify the order. If we cancel an order after you have paid, we will refund the amount paid for the cancelled products.
Payment is taken through our secure checkout using the payment methods shown there. Any taxes and shipping charges are shown at checkout before you place your order.
4. Order Changes and Cancellations
Please contact us as soon as possible if you need to change or cancel an order. Orders may be processed by our suppliers shortly after they are placed, and a cancellation takes effect only once we confirm it in writing. Section 2 of our Refund policy sets out cancellation terms, including orders already in transit.
5. Availability and Supplier Fulfillment
Many products are supplied and shipped by independent manufacturers and suppliers. Availability, lead times and inventory can change without notice. If an ordered product turns out to be unavailable and we cannot reasonably fulfill it, we will tell you and refund the amount paid for that product, as described in section 1 of our Refund policy. We will not substitute a different product without your agreement.
6. Made-to-Order Products
Some products are made to order, and their production lead time is in addition to transit time. Ecore products that are made to order have an estimated production lead time of 2–3 weeks from order placement, before shipment, unless otherwise stated for the specific product or confirmed in writing by Flooritize. Lead times are estimates, not guaranteed delivery dates. Made-to-order products may be subject to additional cancellation and return restrictions under the applicable supplier terms and our Refund policy.
7. Shipping, Delivery Estimates and Transit
Shipping and freight charges are calculated at checkout. Delivery dates are estimates and are not guaranteed unless we confirm a guaranteed date in writing. For orders with a merchandise subtotal of $10,000 or more, the shipping charge shown at checkout is an estimated base freight amount, as explained in our Shipping policy.
Please give accurate delivery details and a reachable phone number, make sure the delivery location can safely receive the shipment, and inspect deliveries promptly. Report visible damage, missing items or incorrect products to us promptly, as described in section 6 of our Refund policy. Responsibility for loss or damage in transit is determined by the applicable shipping arrangements and applicable law.
8. Measurements, Quantities, Suitability and Installation
You are responsible for choosing products suitable for your project and for confirming measurements, quantities, specifications and installation requirements before ordering. Coverage figures and calculator results on the website are planning aids, not guarantees of the exact quantity you will need. We recommend ordering extra material for cuts, breakage and future repairs, and confirming quantities with a qualified installer for complex projects.
Please inspect products before installation. Do not install, cut or alter a product that appears damaged, defective or incorrect before contacting us. Installation decisions, methods and workmanship are the responsibility of you and your installer. Section 7 of our Refund policy sets out related terms.
9. Returns, Refunds, Shipping Charges and Restocking Fees
Returns, refunds, return shipping, restocking fees and related deductions are governed by our Refund policy. In summary, returns need prior written authorization and are subject to the applicable supplier’s rules, and original shipping and freight charges are generally non-refundable unless the law requires otherwise or we agree in writing. If anything in these Terms conflicts with the Refund policy on these subjects, the Refund policy applies.
10. Manufacturer Warranties and Supplier Terms
Some products are covered by a manufacturer’s limited warranty. Warranty coverage, exclusions and claim procedures are set by the manufacturer’s warranty terms. Supplier terms may also apply to particular products. Links to supplier resources are listed in section 9 of our Refund policy. We may help you contact the relevant manufacturer or supplier, but we do not give any additional warranty of our own unless we state it in writing. Manufacturer warranties do not limit rights you have under applicable law.
11. Intellectual Property and Website Content
Content created by Flooritize for this website, including text, layout and design, belongs to Flooritize or its licensors. Manufacturer names, brand names, logos, trademarks and product images belong to their respective owners. You may view and print website content for your personal, non-commercial use in connection with shopping with us. You may not copy, reproduce, republish, scrape or commercially use website content without permission. Our Legal notice gives more detail.
12. Website Availability, Errors and Corrections
We aim to keep the website available and accurate, but we do not guarantee that it will be uninterrupted or error-free. The website may contain errors in pricing, descriptions, images, availability or other information. We may correct errors and update information at any time, including after an order has been placed, and where an error affects your order we will contact you before proceeding. Links to third-party websites are provided for convenience. We are not responsible for their content or availability.
13. Limitation of Liability
To the extent permitted by applicable law, Flooritize is not liable for indirect, incidental, special or consequential losses arising from your use of the website or products bought through it. This includes installation labor, project delays or lost profits that result from inaccurate measurements, unsuitable product selection, installation before inspection, or installation contrary to manufacturer instructions. We are also not responsible for delays or failures caused by events outside our reasonable control.
Nothing in these Terms excludes or limits liability where that would be unlawful, or affects remedies for defective, misdescribed or incorrectly supplied products where the law provides them.
14. Disputes and Applicable Law
If you have a concern about an order or these Terms, please contact us first so we can try to resolve it. These Terms are subject to the laws that apply to the transaction. Nothing in these Terms limits any consumer protection right you have under the laws of the place where you live.
15. Changes to These Terms
We may update these Terms from time to time. The version on this page shows the date of its latest update. Changes do not affect orders already accepted, except where the law permits or requires it.
